Divorce law is different in a majority of states and each case will require specialized considerations. If there are children in the marriage or property involved, the hiring of an attorney may be necessary for equal division of assets.

Divorce in the majority of situations is not a case of saying it is over and walking away. The laws of divorce do vary among the states and it is important to know which would apply to your particular situation. Some can opt for a no fault divorce. This is when neither party has done wrong doings; there are simply differences that are irreconcilable. If filing for divorce and have reason such as spouse is incarcerated or there has been abuse or infidelity, this would not qualify as a no fault.

Dissolution of marriage is when both people agree to the all areas of ending the marriage. This includes property division. Property would include the residence, vehicles and contents of the residence. If at any time during the preparation of dissolution there are any disagreements on the dividing of items, there will most likely be a need to file divorce proceedings.

How assets are divided will differ in each state, however, the majority applies an equal split among both people. If you live in different states, in most cases the person who filed is where the proceedings will take place and that states law will be used.

Should there be children under the age of eighteen from the marriage, this could pose custody difficulties. States vary as to who they award custody to. Many families opt for shared parenting which is great for families that reside in the same state, but if one is outside the state it could be extremely difficult for the children. The situation where this works best is when both reside in the same school district as to not disrupt the children.

Should no children and no property of value be involved, the divorce could be a fairly simple process. Should there be questions regarding custody or who gets the house, a Divorce law attorney should be contacted. Separating is difficult and when there are drawn out court cases it becomes excruciating so having legal representation may be needed.
