Divorce rates lately have increased in our society. Many couples are going through the dreaded process.
It’s tough to say whether or not more individuals wish to get divorced or whether it’s simply more acceptable. It’s a moot point, the point is divorce is commonplace.
One result is there are a lot more family attorneys. That said, more and more spouses also choose not to hire an attorney.
Lawyers aren’t always necessary and in some cases aren’t good because of the cost. If couples can work it out themselves, that is excellent.
1. Spouses can try to hammer out terms on their own.
If you stave of litigation disaster at this stage, that is an excellent result. Wrapping it up is simply a matter of the paperwork. Be sure to get the terms in writing in an agreement.
2. Many divorces process amicably through mediation. Hiring a third party to facilitate negotiations has a very high success rate.
If mediation works, the mediator can draft up an agreement for signing.
3. Each party hires attorneys but continue with the peaceful resolution method – which is to keep the lines of communication open between attorneys.
4. The spouses decide to hire an arbitrator knowledgeable about family law. The arbitrator hears the case and decides the issues.
Number 4 is a good option because it’s fast and won’t drain all the money. It can be done with attorneys or without attorneys.
5. If agreement is still impossible, then it’s a full blown litigation file. If this happens, the decision is outside of your control.
It’s a good idea to consult a lawyer to get an opinion about your rights. You don’t need to hire the lawyer for full out litigation.
You can talk to a lawyer at any time if you’re at all unsure about what your legal rights are. Don’t give away the farm; however do expect to compromise if negotiating. You can take full advantage of all the negotiation steps with or without a lawyer.
