Use Of The Oklahoma Child Support Calculator Written on May 21, 2010, by Joseph St. James.

The laws for Oklahoma in regards to support payments are different than other states. Enforcement is a priority within all states. In all states those that do not pay in accordance with a judgement are severely punished. To determine the amount of payment within Oklahoma be sure to use the Oklahoma Child Support Calculator as a guide to expected payment.

Oklahoma law provides that if payment is not made then this amount is added to the paying parent’s judgement amount plus a per year accrual of interest. Because this is automatically applied the receiving party will not be required to file regarding this action. The receiving party will be required to file actions regarding garnishment of wages. Please seek reliable legal counsel regarding these actions.

Another action that the receiving party can take under Oklahoma law is to file a contempt action. If the paying parent is found in contempt they can be sentenced to jail time. The judge also has the option to impose a fine and can also order that a drivers permit be revoked.

Legal counsel will assist with all actions including those relating to garnishment. There are some automatic actions such as the accrual of interest for non-payment. Some states will also add fees to a judgement that is not routinely paid.

Organizing all pertinent documents is a must. This will determine the ease that your counsel will have in accessing the information and applying it to your case. Any emails or written letters between both parties should be kept for possible use in determining payment.

Should one become under-employed, laid off or terminated it is possible to request a modified payment arrangement. The amount of the judgement will not be lowered. If unemployment benefits are available to the paying parent then those wages can be actioned for garnishment. This may also apply for disability payments, lottery winnings or other sources of income.

Deviating from the state’s guidelines for the award of payment can be petitioned. If it is found to be in the interest of the child it will be considered by the state. If the modification does not show to improve or maintain the well being of the child it will be rejected.

By law each state is responsible for governing the calculation of support payment. Thus, to determine payment within the courts of Oklahoma be sure to use the Oklahoma Child Support Calculator.
