The term of divorce has often been played around over the last century. Divorce is the legal process of terminating marital duties to your partner, usually of the matrimonial basis. All duties like legal responsibilities to both husband and wife are considered null. A lot of countries usually have varied views regarding divorce, because while some countries condone divorce, other countries will usually tolerate it. Countries that do not allow divorce will allow annulment however, which is another case.
Processes involved in legal divorce will usually include drawing an agreement of some sorts for a lot of things affecting the daily lives of those involved. Spousal support, division of property, division of debt, and for children involved in the division, child custody and child support. All of these are handled by court, with decisions affecting reason by divorce. The favor for division will usually go to the injured party.
In a majority of countries, divorces are handled in legal terms and certified by court to be acknowledged. The conditions of living are determined all in court, including the division of assets, debts and such. Agreements that were made before marriage will precede the power of the court though, so conditions are also considered before the court’s decisions as well.
First off, there is mediation in the divorce council, wherein resolution for the divorce is decided by both parties without legal advice or council from lawyers and the court. The court is still needed to have ratification of the divorce contract, however division and custody are all decided upon by both parties with only the presence of a non-influencing third party. The mediator is there to only oversee the discussions but cannot influence any of the decisions.
Collaborative divorce, in another case, is the voluntary agreement between both parties to separate without any threat of litigation. It is an agreed and mutual separation. It is almost similar to a mediated agreement but without the mediator. The contracts are drawn with both parties agreeing to it, and upholding the agreement to the very end of the divorce process.
