Most of the time, they approach the situation all wrong. This article will examine the right way to fight for custody – and win a custody battle.
The easiest way to get the child custody arrangements you want is to come to an agreement outside of the courts with the other parent. An attorney can often help you do this.
If you do go to court, the first step is formal, court ordered mediation. This is an important part in determining who gets custody. The mediator’s job is to help you work out an agreement without you having to go to trial.
First impressions count with the mediator. In many counties, the mediator will make a report which the Judge takes seriously in determining his or her decision regarding final custody orders. Your goal should be to come across as a reasonable parent who wants the best for their children and are willing to work with the other parent to come to a parenting plan.
Trial is the next step if mediation doesn’t produce a parenting plan. At trial, you can put on witnesses and present evidence. Unlike ordinary trials which go from day to day until completion, family law trials tend to be scheduled in two hour increments and you may have to come back on several different occasions before the case is finished.
The best solution for everyone is for you and your ex to work out a parenting plan outside of the court system. But this isn’t always possible if your ex is being unreasonable. If so, you will need to go to court which includes going to mediation and then sometimes trial.
Should you put up a fight when it comes to child custody? Of course you want what is best for yourself and your children. If you can work things out with your ex, you will save yourself a lot of expense and anxiety. But sometimes fighting means getting a good attorney and being prepared to go to trial.
